A multi-car accident left an elderly Maryland couple dead at Highland Park in New Brunswick, NJ on a Tuesday evening. The couple, Peter Palmer, 75, and Carol Paul, 77, were pronounced dead at the scene. They were not married, but were in a romantic relationship, according to the prosecutor. The crash occurred at approximately 5:32 p.m. at the intersection of Route 27 and North 10th Street in Highland Park. A Mercedes, operated by Abeer Viriani, 34, of Iselin, struck a Subaru occupied by the Maryland couple.
Viriani also struck a Hyundai Elantra, and the driver of the Elantra sustained minor injuries. He had suffered serious injuries and was later transported to Robert Wood Johnson University Hospital in New Brunswick. That same night, Viriani was arrested and charged with two counts of first-degree aggravated manslaughter and two counts of second-degree vehicular homicide. Viriani is being held pending a pre-trial detention hearing in Superior Court.
The crash had shut down Route 27 for several hours that night. The prosecutor did not say if speed was a factor in the crash, but detectives are investigating. The Middlesex County Prosecutor asks that anyone with information or surveillance footage of the area is asked to call Officer Kevin Garrity of the Highland Park Police Department at 732-572-3800 or Detective Matthew Colonna of the Middlesex County Prosecutor’s Office at 732-745-3354.
Losing a loved one can be difficult and painful, but it is even worse when negligence may have played a role in the death. In such cases, filing a wrongful death lawsuit can help bring justice and compensation to the grieving family. This blog post aims to shed light on what constitutes a wrongful death case, the common causes behind them, the potential damages involved, and the crucial decision of when to hire a lawyer.
Defining a Wrongful Death Case
A wrongful death case arises when an individual’s death is caused by the negligence, intentional harm, or wrongful act of another person, company, or entity. As our experienced wrongful death lawyer knows, these types of cases are usually brought forward by family members.
Common Causes of Wrongful Death
Wrongful deaths can occur due to various circumstances, including car accidents, medical malpractice, workplace accidents, defective products, nursing home negligence, or even criminal activities. Every case is unique, so it is important to establish a clear and direct link between the negligent actions of the party and the victim’s death.
Damages in a Wrongful Death Case
A wrongful death claim seeks to provide financial compensation for surviving family members for the losses that they have endured. Damages can include financial losses such as medical expenses, funeral costs, loss of income, and future financial support. Additionally, non-economic damages such as pain and suffering, loss of companionship, and emotional distress may also be awarded.
When to Hire a Lawyer
Going through a wrongful death case like the one that took the lives of the Maryland couple can be hard and requires an intricate understanding of the laws involved. It is advisable to hire an experienced wrongful death lawyer to handle the legal proceedings, conduct investigations, gather evidence, negotiate with insurance companies, and represent your best interests in court. Seeking legal counsel promptly ensures that you meet important deadlines and have the necessary guidance during this challenging time.
Wrongful death cases offer a means to hold responsible parties accountable for their actions, while providing financial support for the surviving family members. How To Choose The Right Wrongful Death Lawyer For Your Case
Losing a loved one due to someone else’s negligence is a heart-wrenching experience. While no legal action can undo the pain, a wrongful death lawsuit can provide justice and financial relief for the surviving family members. Choosing the right wrongful death lawyer is crucial for the success of your case. Here are some steps to help you find the right legal representation.
1. Understand Your Needs
Before you begin your search, take time to understand your specific needs. Wrongful death cases can arise from various circumstances such as medical malpractice, car accidents, workplace incidents, or defective products. Identifying the nature of your case helps you find a lawyer with relevant experience.
2. Seek Recommendations
Start by asking friends, family, or colleagues for recommendations. Personal referrals can provide valuable insights into a lawyer’s competence and approach. If you know any legal professionals, even if they specialize in different areas, they can often refer you to reputable wrongful death lawyers.
3. Research Potential Lawyers
Conduct online research to compile a list of potential lawyers. Look for attorneys who specialize in wrongful death cases. Check their websites for information about their experience, case results, and client testimonials. Online legal directories and bar association websites are also useful resources for finding qualified lawyers.
4. Check Credentials And Experience
Verify the credentials of the lawyers on your list. Ensure they are licensed to practice in your state and have a strong background in wrongful death law. Experience is crucial in these cases, so look for lawyers who have successfully handled cases similar to yours. This includes checking their track record in settlements and court trials.
5. Read Reviews And Testimonials
Client reviews and testimonials can provide insight into a lawyer’s reputation and effectiveness. Look for reviews on third-party sites, as these are often more balanced and reliable. Pay attention to feedback regarding the lawyer’s communication skills, empathy, and ability to achieve favorable outcomes.
6. Schedule Consultations
Narrow down your list to a few top candidates and schedule consultations with each of them. Many wrongful death lawyers offer free initial consultations. This meeting allows you to discuss your case, ask questions, and assess whether the lawyer is a good fit for your needs.
7. Prepare Questions
Prepare a list of questions to ask during your consultations. Key questions might include:
- What is your experience with wrongful death cases similar to mine?
- How do you approach these cases?
- What are your fees and payment structure?
- How do you communicate with clients throughout the case?
- What is your assessment of my case?
8. Assess Communication And Empathy
A good wrongful death lawyer should be not only knowledgeable but also empathetic and communicative. Assess how well the lawyer listens to your concerns and explains legal concepts. You should feel comfortable and confident in their ability to represent you.
Choosing the right wrongful death lawyer is a crucial step in seeking justice for your loved one. By following these steps, you can find a dedicated and experienced lawyer who will fight for your rights and help you navigate this challenging time.
