Drunk Driver Charged With DWI

James Cannici, a 20-year-old resident of Old Bridge, was arrested and charged with Driving While Intoxicated (DWI) and causing a fatal accident on Route 18 near Ferris Road. The accident happened when Cannici, who was driving a Nissan Rogue, turned from Ferris Road into the wrong lane of Route 18, and as a result collided with two vehicles.

The Middlesex County Prosecutor’s Office and the Old Bridge Police Department conducted an initial investigation, determining that three vehicles were involved in the crash. Florence Akoma, a 45-year-old passenger in the Honda Accord, was tragically pronounced dead at the scene. The driver inside the Honda Accord sustained major injuries and received treatment.

Following his arrest for DWI at the crash site, Cannici now faces additional charges. Today, he was charged with first-degree Aggravated Manslaughter, second-degree Vehicular Homicide, third-degree Aggravated Assault, and fourth-degree Assault by Auto. Cannici was transported to Middlesex County Adult Correctional Center awaiting detention.

The investigation into the accident continued for hours after the incident. Authorities are urging anyone with relevant information or surveillance footage to come forward and contact Detective Haviland of the Old Bridge Police Department or Detective Alleva of the Middlesex County Prosecutor’s Office. It is important to remember that the charges against Cannici are accusations, and he is presumed innocent until proven guilty in a court of law.

What Is Wrongful Death?

Wrongful death is a legal term used to describe a situation in which an individual’s death occurs due to the negligence, misconduct, or intentional actions of another party. Family members are eligible to file a wrongful death claim to seek compensation for their losses, as a wrongful death lawyer like one from Law Firm of Edward Blinder, PLLC can explain.

Establishing Wrongful Death

For a claim to be successful, it is essential to have strong evidence. This evidence typically includes documentation of the defendant’s negligence or wrongful act, such as medical records, accident reports, witness testimonies, or expert opinions. Gathering evidence is a complex process that requires legal expertise and resources to ensure a strong case. The eligibility to file a wrongful death claim varies depending on the jurisdiction, but generally, immediate family members like spouses, children, or parents of the deceased have the right to bring forth the claim. In some cases, a representative of the deceased’s estate may also file the claim on behalf of the family members.

Why Hire A Lawyer

Hiring a wrongful death lawyer is highly recommended for several reasons. Wrongful death attorneys have access to a network of experts who can help strengthen the case by providing professional opinions and conducting thorough investigations. They have strong negotiation skills and can effectively negotiate and secure a fair settlement. If necessary, they are also prepared to take the case to trial and advocate for the family’s interests in the courtroom.

File a Claim

Losing a loved one due to someone else’s negligence or misconduct is devastating. A wrongful death claim seeks to provide some measure of justice and financial support to the surviving family members. By hiring a wrongful death lawyer, the family can focus on healing and grieving while having a dedicated legal professional fighting for their rights and pursuing the compensation they deserve.
